Overview
This document, along with any annexures, schedules, and appendices referenced or attached hereto (collectively, the “Agreement”), constitutes a legally binding agreement between you and FO76Vault located in Singapore (“FO76Vault”, “we”, “us”, or “our”).
This Agreement covers:
- The services provided by FO76Vault (“Services”); and
- Your access to and use of fo76vault.com (“Platform”).
The Services are available to:
- Individuals aged 18 and over who possess the legal capacity to enter into binding contracts under applicable laws; and
- Minors under 18, provided they have the consent and are under the direct supervision of a parent or legal guardian. All actions undertaken by individuals under 18 in accordance with this Agreement are considered to have been approved by their legal guardian or parent, who assumes full responsibility for all such activities.
Definitions
- Account: Your registered account to access or use the Platform.
- Business Day: Any day that is not a Saturday, Sunday, or a public or bank holiday in Singapore.
- Buyer: The purchaser of any digital items, goods, and/or services on the Platform.
- Goods and/or Services: The digital items, goods, and/or services listed or offered for sale on the Platform by Sellers.
- FO76Vault Services: The array of services and features offered by FO76Vault on the Platform, facilitating transactions between Sellers and Buyers.
- Information: Data, content, specifications, audio or video clips, graphics, and any other materials.
- Intellectual Property Rights: Rights related to patents, copyrights, trademarks, service marks, and all other forms of intellectual property.
- Sale Contract: The sale agreement between a Seller and a Buyer executed through the Platform.
- Seller: A registered user of the Platform who lists or offers Goods and/or Services for sale.
- Personal Data: As defined in our Privacy Policy.
- Privacy Policy: The policy detailing the handling and protection of Personal Data by FO76Vault, available on our Platform.
- Platform: Refers to the website fo76vault.com, including any mobile applications or mobile sites operated by FO76Vault.
- Registration Process: The process established by FO76Vault for users to register and create an Account.
- Representatives: Employees, agents, contractors, and any other representatives of a party.
- You/Your: Users of the Platform, including both Sellers and Buyers.
General Conditions
- Singular terms include plural meanings and vice versa.
- References to laws include all regulatory guidelines, statutory instruments, and modifications.
- Section headings are for convenience only and do not influence interpretation.
- References to any party include their successors and permitted assigns.
- No construction rule disadvantaging the drafting party applies.
- “Including” and similar terms are illustrative, not limiting.
Access and Use of the Platform
- To access FO76Vault Services, you must create an Account following the Registration Process. Successful registration grants access to the Platform and its services.
- You are responsible for maintaining the confidentiality of your Account’s login details and must promptly inform FO76Vault of any unauthorized access.
- Monitor your Account’s activity closely, report any unusual transactions, receive erroneous data, or obtain information not intended for you, without using or disclosing such information without written consent from FO76Vault.
- Each individual is limited to one Account, and accounts must not be created on behalf of others or to impersonate another person. FO76Vault reserves the right to suspend accounts found to be fraudulently created.
Transactions and Contracts
- All Sale Contracts are solely between the Seller and Buyer, excluding FO76Vault from any liability or warranty regarding the Goods and/or Services. FO76Vault is not liable for any issues arising from transactions or modifications to the Buyer’s game account by game developers.
- You agree not to modify or cancel Sale Contracts except with written agreement from FO76Vault and are responsible for any losses incurred by FO76Vault due to such actions.
- In case of disputes, it’s encouraged to resolve issues amicably. FO76Vault may facilitate but is not obligated to resolve disputes.
Seller Obligations and Rights
- Sellers are responsible for ensuring they have the right to list and sell their Goods and/or Services on the Platform and must comply with FO76Vault guidelines.
- FO76Vault reserves the right to categorize Sellers and set pricing guidelines.
Refund Policy
- All purchases made through our website are considered final. We take pride in our services and want you to be satisfied with them. However, we also need to ensure that our policies are clear and respected to continue providing the best possible offerings to all our customers.
- Notwithstanding the above, refunds may be considered under the following limited circumstances:
- Defective Product or Service: If the product or service received is defective or not as described on our website, you may be eligible for a refund. Please provide a detailed description of the issue and any relevant evidence (e.g., photos or screenshots) within 24 hours of purchase to support your claim.
- Failure to Deliver: If seller fails to deliver the purchased product or service within the specified delivery timeframe as noted on our website, and no mutually agreeable resolution can be found.
- Legal Requirements: Any other circumstances where local consumer protection laws require a refund.
- To request a refund under the conditions listed above, please contact our customer service team at gamerkiosksg@gmail.com with your order number, the reason for the request, and any supporting documentation. Our team will review your request according to our policies and applicable laws, and we will inform you of the decision within 24 hours.
- Please note that refund requests that do not meet the specified conditions will not be entertained, underscoring the importance of reviewing your order before finalizing your purchase.
- By making a purchase on our website, you acknowledge and agree to this refund policy. Please ensure you have read and understood our terms before completing your transaction.
Payment and Financial Terms
- Payments to and from Buyers and Sellers are processed in accordance with the stipulated payment procedures.
- FO76Vault may require a security deposit or withhold payments as deemed necessary.
General Obligations
- Comply with all applicable laws and obtain necessary consents and permissions.
- Use the Platform and FO76Vault Services in accordance with this Agreement and any guidelines provided by FO76Vault.
Use of Platform/Services
- FO76Vault grants a non-exclusive, non-transferable right to access and use the Platform and Services for the purposes outlined in this Agreement.
- You are prohibited from misusing the Platform, infringing intellectual property rights, and engaging in unlawful activities.
Information and Data
- Ensure all information provided is accurate and does not infringe on third-party rights.
- Comply with the Privacy Policy regarding the handling of Personal Data.
Links and Third-Party Content
- FO76Vault is not responsible for Third Party Sites/Content linked on the Platform.
Personal Data
- Personal Data collected will be handled in accordance with the Privacy Policy.
Confidentiality
- Confidential Information must not be disclosed except as permitted by this Agreement or required by law.
Intellectual Property
- Intellectual Property Rights are protected and must not be infringed upon.
Consumer Protection
- This Agreement does not override consumer protection laws where applicable.
Warranties and Disclaimers
- FO76Vault warrants the Services will be provided with reasonable care but does not guarantee the accuracy of information provided by third parties.
Liability Limitations
- FO76Vault’s liability is limited as outlined in this Agreement.
Indemnification
- You agree to indemnify FO76Vault against all liabilities arising from your use of the Platform and Services.
Force Majeure
- FO76Vault is not liable for delays or failures in performance resulting from events beyond its control.
Termination and Suspension Rights
- FO76Vault may terminate this Agreement or suspend your access to the Platform under certain conditions.
Changes to Agreement
- FO76Vault reserves the right to amend this Agreement, with changes effective upon notice.
Governing Law
- This Agreement is governed by Singapore law, with Singapore courts having exclusive jurisdiction.
